Supreme Court Grants Cert on Sentencing Issues:
The Court granted cert in two cases today to determine when the length of a federal criminal sentence is "reasonable" and thus allowed under Booker. Expect lots of blogging on this from Doug Berman over at Sentencing Law & Policy.

It is needed but I agree with the SG that some of the substantive issues are subtle at best (particularly with respect to a "presumption of reasonableness" and what it means if such a presumption does/does not apply).

And only a couple of years late, too. Although I think the CTAs have done a remarkably good job hammering these issues out in the time they've had, considering the number and complexity of the potential issues.

seriously, nobody knew what the hell was going on, and everybody knew everybody else was just sort of making stuff up waiting for the Court to tell them. in light of that, the circuits have done a pretty good job.

question: has ginsburg ever commented publicly on her failure to write a concurrence as the swing vote in the remedial opinion?
