Samaha on the New Supreme Court Term:
The Chicago faculty blog has posted a very interesting podcast of a recent talk by law prof (and former Stevens clerk) Adam Samaha on the upcoming Supreme Court term, including his thoughts on the likely internal dynamics of the new Court and the role of swing votes.

Leaving aside the Roberts issues, this is a very strange argument against the view of Kennedy as a swing justice. Basically he says that Kennedy has some very conservative positions in addition to his agreement with the liberals, and therefore he isn't a very good candidate for being called a swing justice. Isn't that rather an extremely good reason for calling him a swing justice?
