Jurist Column On Bankruptcy Reform Legislation:

Perhaps I was the last to know, but last week Jurist ran an op-ed column that I wrote earlier this summer on the Bankruptcy Reform legislation. I knew that it had been delayed for a while, but I didn't realize that they had finally posted it.

This column ignores the rather large increase in transaction costs that will be associated with the new bill. Bankruptcy judges will now have to determine, through the rather complicated formula dictated by the bill, whether each person meets the criteria. Then if this legislation really does affect a significant number of cases we have the bankruptcy court supervising these people under Chapter 13 for several years. I'd be really interested to see a CBA.
